What exactly is the meaning of a labor market test and in what situations is it necessary?

The starosta’s opinion is a document issued by the labor office that confirms the shortage of qualified employees on the local labor market for a given company. The condition is the lack of local candidates who meet the employer’s requirements for a given position. If such a candidate is found and the employer does not employ him, the starosta will issue information indicating the possibility of meeting the staffing needs. In such a situation, the employer will not receive permission to employ a foreigner.

How to obtain?

This document contains all conditions such as: amount of money, position, activity time as well as requirements and qualifications required for this task. How much is? How long does it take to get it?

The starosta’s opinion does not generate any costs. The office issues it within 21 days of reporting the job offer by the labor office. The opinion must be issued no earlier than 180 (or 90) days before applying for a work permit. Of course, exceptions for short-term conditions may be justified by the mayor. The labor market test is a key document that enables foreigners to take up work. Without this certificate, they will not be able to legalize their stay on the basis of paid work.

However, there are situations in which the starosta’s opinion is not required. For foreign workers, this is essential when applying for a temporary residence permit for work or work requiring high qualifications (so-called blue card). It is also necessary to obtain a work permit for a foreigner whom the entrepreneur plans to employ.

Is it possible to obtain a work permit in Poland without the opinion of the starosta?

  1. List of professions specified in the regulation of the Minister of Family, Labor and Social Policy of June 28, 2018 (Journal of Laws of June 29, 2018, item 1264), including: doctors, nurses, programmers, database designers, carers for the elderly, bricklayers, painters, locksmiths, bus and truck drivers.

  2. Citizens of Armenia, Belarus, Georgia, Moldova, Russia or Ukraine, employed in Poland in nursing and care positions or as domestic help in the households of natural persons.

  3. Foreign citizens working in sports centers as sports coaches or athletes, as well as those who are authorized to represent a foreign entrepreneur in his branch or representative office in Poland.

  4. People with the Pole’s Card.

  5. Citizens of Armenia, Belarus, Georgia, Moldova, Russia or Ukraine who have worked for at least 3 months in the same entity and in the same position before submitting an application for a work permit, provided that a written declaration of the intention to employ a foreigner is registered by the Labor Office competent for the place of permanent residence or registered office of the entity, documenting it with appropriate contracts and documents confirming the payment of health insurance contributions.

  6. Graduates of universities in Poland, another country of the European Economic Area or the Swiss Confederation, or those who obtained a doctoral degree in Poland before submitting an application for a work permit.

  7. Persons who, during the three years before submitting the application for a work permit, resided legally in the territory of Poland for three continuous years as part of an artistic residency, in accordance with Art. 4 of the Act of 12 December 2013 on foreigners.
